Florida Workers’ Compensation Law Change

The Florida Legislature passed and the Governor signed into law CS/HB 941 which amends sections 440.02(9) and 440.05, Florida Statutes. These amendments will streamline the filing and processing of exemption applications.

Some of the highlights of CS/HB 941 are:

  • Provides applicants the ability to electronically file their applications via a web-based System.
  • Eliminates the requirement for the application to be notarized; and eliminates the need to submit a copy of the stock certificate or documentation of ownership evidencing 10% ownership in a company.

Additionally, the legislative changes provide that all Certificates of Elections to be Exempt issued on or after January 1, 2013, are valid for 2 years after the effective date and beginning July 1, 2013, non-construction LLC. members will be treated as corporate officers and will be eligible to apply for a Workers Comp exemption.

On July 1, 2012, a new Division of Workers Compensation Notice of Election to be Exempt web-based system will be available for applicants to electronically apply for or renew their Certificate of Election to be Exempt. The website is www.myfloridacfo.com/wc. Once on the website, click on the “Apply for an Exemption” icon in the middle of the webpage.
